Welcome to Zuka Lift.
These Terms and Conditions (“Terms”) govern your access to and use of the Zuka Lift mobile application, driver app, website, and all related services (collectively, “the Platform”). By registering, accessing, or using the Zuka Lift Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
“Zuka Lift”, “we”, “our”, “us” refers to Zuka Lift (Pty) Ltd, a private company incorporated under the laws of South Africa.
“User” refers to any person who registers for or uses the Zuka Lift services, including riders, drivers, and delivery partners.
“Driver” refers to an independent contractor who provides transport or delivery services via the Zuka Lift Platform.
“Rider” refers to a person who requests or receives transport or delivery services through the Platform.
“Platform” refers to the Zuka Lift apps, website, APIs, and related systems that enable e-hailing and payment functionalities.
“Trip” or “Ride” means a transport service facilitated through the Zuka Lift Platform between a Rider and a Driver.
“Applicable Law” includes the Consumer Protection Act (CPA), Protection of Personal Information Act (POPIA), National Land Transport Act, and all relevant municipal or provincial transport regulations.
By downloading, installing, registering, or using the Zuka Lift Platform, you acknowledge that:
You are at least 18 years old and have full legal capacity.
You understand and agree that Zuka Lift is a technology platform, not a transport operator.
You are entering into a binding legal agreement with Zuka Lift (Pty) Ltd.
You consent to the processing of your personal information in accordance with our Privacy Policy.
Zuka Lift provides a digital marketplace that connects passengers with independent drivers or delivery partners. Zuka Lift does not own vehicles, employ drivers, or provide transportation services directly. Each ride is a contract between the rider and the driver, and Zuka Lift acts as an intermediary.
To use Zuka Lift, users must create an account by providing accurate personal details such as:
Full name, mobile number, and valid email address
Profile photo and identification documents (for drivers)
Payment details (bank or card information)
Users are responsible for:
Maintaining the confidentiality of their login credentials
Restricting access to their devices
Immediately notifying Zuka Lift of any unauthorized access or suspicious activity
Zuka Lift is not liable for any loss resulting from your failure to safeguard your credentials.
Drivers must complete verification checks, which may include:
Criminal record screening
Driver’s license validation
Vehicle inspection and insurance confirmation
Compliance with regional transport permits
Zuka Lift reserves the right to suspend or deactivate accounts that fail verification.
Users agree to:
Use the app only for lawful purposes
Not engage in fraudulent, abusive, or unsafe behavior
Follow all instructions, safety requirements, and applicable traffic laws
Avoid using the Platform to transport illegal goods, weapons, or substances
Drivers must ensure vehicles are roadworthy, insured, and licensed in accordance with transport regulations.
When a Rider requests a ride:
The app displays an estimated fare and route.
A Driver can accept or decline the request.
Once accepted, a contract is formed between the Rider and Driver.
Riders may cancel before the driver arrives, but cancellation fees may apply.
Drivers may cancel only under reasonable circumstances (e.g., unsafe conditions).
Repeated cancellations may result in suspension.
Both parties agree to behave respectfully. Harassment, discrimination, violence, or unsafe conduct will result in permanent termination of the account.
Fares are calculated based on distance, duration, and dynamic pricing factors (traffic, demand, location).
All prices include applicable VAT and regulatory fees.
The final fare is shown in the app after trip completion.
Riders can pay using:
Debit/Credit cards
Mobile wallet (Zuka Wallet)
Paystack or other integrated payment gateways
Drivers are paid automatically to their linked accounts after Zuka Lift deducts its service commission.
Refunds are processed on a case-by-case basis. Users must report issues within 48 hours of the ride via the in-app support feature or email. Zuka Lift’s decision on fare disputes is final.
Zuka Lift charges drivers a service commission or platform fee per completed trip. The percentage is visible in the driver’s dashboard and may change with notice.
Promotional discounts or coupons do not affect the driver’s agreed fare share.
Drivers are required to maintain valid third-party or comprehensive vehicle insurance.
Zuka Lift may offer optional insurance coverage, but this does not replace the driver’s legal obligations.
Zuka Lift is not liable for accidents, damages, or personal injuries that occur during rides unless caused by gross negligence on its part.
All claims related to accidents or loss must be reported to the driver’s insurer and relevant authorities.
Zuka Lift prioritizes safety through:
Real-time GPS tracking
In-app SOS emergency button
Driver background checks
Passenger and driver rating systems
Users must not:
Use the service while intoxicated
Endanger others or damage property
Refuse payment or overcharge
Record or share another user’s data without consent
Repeated violations may result in immediate suspension or legal action.
Zuka Lift may offer referral bonuses, loyalty points, or discounts. These are:
Non-transferable and may have expiry dates
Subject to change or termination at any time
Not redeemable for cash unless expressly stated
All content on the Platform — including logos, designs, software, databases, text, graphics, and trademarks — remains the property of Zuka Lift (Pty) Ltd.
Users may not copy, reproduce, or reverse-engineer any part of the app or website.
Your personal information is processed according to the Zuka Lift Privacy Policy, which complies with POPIA and GDPR.
By using the Platform, you consent to data collection, storage, and sharing for lawful business and safety purposes.
Zuka Lift may suspend or permanently terminate user accounts if:
There is misuse, fraud, or illegal conduct
The user violates these Terms
Required documents expire or are invalid
Payment or identity verification fails
Termination may result in loss of access to the Platform and any credits or promotions.
To the fullest extent permitted by law:
Zuka Lift is not responsible for delays, losses, or damages caused by third parties or system outages.
We are not liable for indirect, consequential, or punitive damages (including lost profits).
Zuka Lift’s total liability is limited to the total amount paid for the ride giving rise to the claim.
You agree to indemnify and hold harmless Zuka Lift, its directors, employees, and affiliates from any claims, losses, or damages arising out of your:
Breach of these Terms
Misuse of the Platform
Violation of any law or third-party rights
Disputes should first be reported to support@zukalift.com.
If unresolved, parties may refer the matter to mediation or arbitration in accordance with South African law.
The venue of arbitration will be Johannesburg, and proceedings will be conducted in English.
These Terms are governed by the laws of the Republic of South Africa.
Any legal proceedings shall be brought before the High Court of South Africa (Gauteng Division).
Zuka Lift may modify these Terms at any time. Users will be notified through the app or email. Continued use after updates implies acceptance of the revised Terms.
